Asbestos Attorney Ohio / When should you hire a lawyer?

When should you hire a lawyer?

professional lawyers are as diverse as the color spectrum, there are many types of lawyers available to the general public. However, it can be confusing to choose a lawyer for many people who have no understanding of legal issues. If a person is arrested and charged with a crime, initiate a divorce or a lawsuit, they will need a good lawyer.
Obviously, if a person is put to the test will need a lawyer to defend himself. And 'rightof all Americans is that the lawyer for defendants during the trial. However, the accused will be better served with an experienced attorney handpicked. In all cases, when the process, a person will need a lawyer.

t's never a good situation for a family or a couple when the divorce proceedings. Because these procedures can become very heated and ugly, it's a good idea to get the representation mediating between the two parties. Aftera good lawyer when you divorce a person of their fair share of marital property. Cases appear to be in vogue in the United States today because it offers a place to get money quickly without working. I'm not saying that all cases are frivolous, but when quoting someone or a company, a lawyer should be consulted. Parallel to this, if someone is prosecuted, it is absolutely necessary to have adequate representation.
Lawyers are oftenjokes, but a need in today's world. They have a lot of knowledge about the legal system that the average person does not have. Having a good lawyer can help a person navigate the treacherous legal system and be sure to get the decision for them in a legal battle.

Bio on Mark Lanier
Recognized as one of the top trial lawyers by The National Law Journal, Mark Lanier is the only plaintiffs’ attorney to be listed as one of 40 most influential attorneys across the United States. His courtroom finesse and creativity contributed to the progression of large action-suit cases. His courtroom showmanship and dedication to clients led to his selection as a “Texas Super Lawyer” from 2003 through 2007, and was named “Impact Player of the Year” in 2005 by Texas Lawyer.
Graduating from David Lipscomb University in 1981 with a B.A. in Biblical Languages and a minor in Economics, he attended the Texas Tech University School of Law. Mr. Lanier received his J.D. in 1984, and began his legal career with Fulbright & Jaworski in Houston, Texas. During his time at Fulbright & Jaworski, he worked primarily in the appellate and trial divisions until he joined the small plaintiffs’ practice of Ernest Cannon and Associates. Mr. Lanier founded The Lanier Law Firm in 1990 with Bill Vernon.
The Lanier Law Firm started as a two-person firm and expanded over the years and now has 45 attorneys from New York, Houston, Palo Alto, and Los Angeles. With the help of fellow associates from the firm, Mr. Lanier participated in the first suit against Vioxx in Ernst v. Merck, winning a $253 million verdict. With verdicts totaling over $480 million, he has represented clients in personal injury, business fraud, corporate disputes, and asset recovery cases.
In 1998, Mr. Lanier led a 21-client case against asbestos manufacturers that resulted in a verdict considered to be the largest in U.S. history at the time for asbestos litigation. He has accumulated over $118 million in verdicts in asbestos cases over the years, and continues to represent asbestos victims across the U.S.
His impressive work has been mentioned by notable publications such as The New York Times, The Wall Street Journal and The National Law Journal. He has been a featured guest on Fox Business News, CNBC and ABC. Mr. Lanier’s turning-point trials have been the subject of several books, highlighting his extraordinary legal showmanship and accomplishments. His performance in the aforementioned Ernst v. Merck trial was described as “frighteningly powerful” by Fortune magazine.
Mr. Lanier is certified by the Texas Board of Legal Specialization and is licensed to practice in Texas, both state and federal. Mr. Lanier is also licensed to practice in the state of New York. Mr. Lanier is a speaker and part-time preacher, founding the Christian Trial Lawyers Association. The organization was designed to minister and guide other principled attorneys in cultivating their careers while maintaining their Christian perspectives. He continues to participate in nonprofit organizations and serves on the Board of Trustees for the Committee for Economic Development.

Fred Baron
Fred Baron, represented his first toxic tort client in the early 1970s. Then, he has built one of the largest toxic tort firms in the United States. Widely recognized as a trailblazer in the area of toxic tort law, one reporter noted,"[i]f the field of toxic torts were the frontier of the American West, Baron would have been driving the first wagon onto the plains." G. Taylor, "Outspoken Texan, Baron Establishes Toxic Tort Domain," Legal Times, Vol. VI, No. 25, at p. 10 (Nov. 21, 1983).
As a result of his work to protect the rights of victims of toxic substances, The National Law Journal has listed Fred as one of the "100 Most Influential Lawyers in the U.S." (The National Law Journal, June 8, 2000). He has been honored as a lawyer who helped shape Texas law during the 20th century in "Legal Legends: A Century of Texas Law and Lawyering" (Texas Lawyer commemorative publication, June 2000) and has been named one of Dallas' top lawyers by D Magazine (May 2001 and May 2005). The University of Texas School of Law has honored him by establishing the Frederick M. Baron Chair in Law, which is held by a senior professor of the law school engaged in original research on lawyering and the civil justice system.
A life-long advocate of the environment, the consumer, and working people, Fred Baron has served as lead attorney in complex tort cases involving MTBE and TCE water contamination, radiation contamination, community lead contamination, toxic waste, and pesticide exposure.
Fred Baron has also been credited for his efforts in defeating class action settlements whereby defendant corporations attempted to settle mass tort claims for a fraction of what individuals would otherwise be entitled to recover through the legal system. Fred has twice led successful battles to convince the United States Supreme Court to de-certify nationwide class action settlements involving the "future claims" of asbestos-related injuries, or claims that might someday be brought by people who develop asbestos-related illnesses in the future. As a result of the United States Supreme Court's opinions in Amchem Products v. Windsor, 521 U.S. 591 (1997) and Ortiz v. Fibreboard Corp., 527 U.S. 815, 119 S.Ct. 2295, 144 L.Ed.2d 715 (1999), future victims of toxic injuries can no longer have their rights compromised by class action settlements in which they have no voice.

Rhode Island Mesothelioma Lawyer and Legal Information

Rhode Island Mesothelioma Lawyer and Legal Information
In a 2005 decision, a Rhode Island Superior Court denied the petition of 39 defendants in various asbestos-related cases to dismiss the suits for reason of 'forum non conveniens.' The principle of forum non conveniens is used in 46 states to dismiss cases that have no significant connection to the jurisdiction in which they are filed. Until very recently, Rhode Island did not recognize forum non conveniens.

Determination of Liability

Rhode Island follows a pure comparative liability system in determining liability for the purposes of assigning damages. Under a pure comparative liability system, a plaintiff may recover damages even if they are found 99 percent at fault in causing their own injuries. If a plaintiff is found to share the fault at all, the amount of damages awarded are reduced in proportion to the percentage of blame assigned to the plaintiff. In other words, if a plaintiff is found 25 percent at fault in causing their own injury and damages were determined to be $100,000, the plaintiff can recover $75,000.
In cases involving multiple defendants, Rhode Island follows the common law principle of joint and several liability in determining judgments. Under joint and several liability, any defendant named in the judgment can be held liable to the plaintiff for the entire amount of the judgment regardless of their share of the fault.

Rhode Island Asbestos Litigation

Rhode Island requires that plaintiffs meet a high standard of product identification, proving that they were actually exposed to products manufactured by or distributed by the defendants. A look at a recent Rhode Island court decision illustrates these principles.
2008 - LaPointe v. 3M Company et al: Homasote, a defendant in the case, moved for summary judgment alleging that the defendant had not met the threshold obligation of product identification. LaPointe stated in affidavit that he was uncertain whether sheetrock he worked with was a Homasote product. The court ruled against the defendant, permitting the case to go forward, concluding with the statement, "this Court reiterates that the questions of whether the Plaintiff was ever exposed to asbestos by working near the Defendant's product or whether such exposure was the cause of Plaintiff's injury are questions for the jury to determine.

By MSN Money staff

All Americans are entitled to free credit reports every year from each of the three major credit bureaus. The credit reports used to cost as much as $9.50 each.

The three major credit-reporting agencies, Equifax, TransUnion and Experian, are each required to provide consumers, upon request, a free copy of their credit report once every 12 months.

The reports will not be sent automatically. Each consumer must request reports one of these three ways:

  • Go to AnnualCreditReport.com, which is the only authorized source for consumers to access their annual credit report online for free.
  • Call (877) 322-8228.
  • Complete the form on the back of the Annual Credit Report Request brochure, and mail it to: Annual Credit Report Request Service, P.O. Box 105281, Atlanta, GA 30348-5281. The brochure, which can be ordered or printed, is available from the Federal Trade Commission. Click here for more information.

A credit report is simply a rundown of your payment history, listing your accounts, balances and your payment behavior for each. It is not a credit score, or FICO, the three-digit gauge of your creditworthiness used by lenders, employers and insurers. But credit scores do use the information on your credit reports in their calculations, so it's important to spot and correct inaccuracies as quickly as possible.

Missouri Asbestos Exposure

Our mesothelioma lawyers are experienced working with victims of asbestos exposure. Most people afflicted with mesothelioma are often exposed to the material during the course of their employment. Many of them were exposed while working in St. Louis, Kansas City and throughout Missouri. These people, concerned only with making a living to support their families, did the jobs they were asked without questioning their employers and the materials they were asked to handle. At hundreds of job sites across the United States, including Missouri, thousands of workers were exposed to asbestos on a daily basis, putting their health, even their lives, at risk.

Unfortunately, direct exposure is not always necessary to have an increased risk of an asbestos-related disease. Simply working around the dangerous material can be enough to expose someone to a dangerous level of asbestos. Family members of those directly exposed to asbestos are also at risk if they inhale fibers brought home on work clothes. This is called “take-home” or “paraoccupational” exposure and can be just as dangerous as direct exposure.

Mesothelioma Lawyers with Experience

At the Simmons firm, our mesothelioma lawyers have been working with clients suffering from diseases associated with asbestos exposure for nearly a decade. In that time, we have represented thousands of individuals from all areas of the United States.
